1.Does it matter who files for divorce?
It makes no difference who files first, except maybe what Courthouse, like Cook County, Chicago or Skokie. Otherwise it makes no difference who files for divorce.
2. How long does it take in Chicago, IL to get divorced?
If you have children it can take from six months to over a year, without children depends on how much money is involved. Overall, more money means longer delays.
3. How does the court decide which parent will get custody of a child?
Now that we have allocation judgments, which tells you who spends the majority of time with child,
sometimes they will do a home study or appoint a lawyer to represent child to report to the court
4. Is joint custody better?
Joint custody is okay if parents get along, but if they are fighting it’s not great for the child.
5. Who has the duty to pay child support?
Both parties now have duty to pay child support.
6. How are child support orders enforced?
The Court enforces “Child support orders”.
7. In reference to Alimony- What is maintenance?
Maintenance is usually awarded to the wife, depending on how many years the couple has been married and how much money both parties make.
8. What is unallocated family support?
Unallocated family support is child support and maintenance are lumped together, and this can have tax advantages.
9. What is Marital property?
Marital property is all property acquired during the marriage, regardless of who bought the property originally.
